    LYNDONVILLE, N.Y. (AP) -
    Herbert Bane, a 13-year-old orphan,
    was killed Thursday when a
    rifle discharged as he and his
    brother handled it. police said.
    Herbert and his brother. Robert,
    15, were playing with the 22-caliber
    rifle in the home of an uncle,
    Keith Bane, in this Orleans County
    village.
    The boys and their five brothers
    and sisters had been living with
    the uncle since their parents were
    killed in an automobile accident
    near here in 1953, police said.

    LYNDONVILLE - A 13-yearold
    Town of Yates boy, one of
    eight children left without parents
    as the result of an auto accident,
    in 1953, was accidentally
    shot and killed Thursday afternoon
    by his 15-year-old brother.
    Pronounced dead at Medina Memorial
    Hospital was Herbert Bane
    of Marshall Road, Town of Yates,
    about four miles west of here. Dr.
    James Sterling, an Orleans County
    coroner, termed the shooting
    "accidental."
    According to the Orleans County
    Sheriffs Department, the dead
    youth and a brother, Robert, returned
    home on a school bus
    shortly after 4 p.m. After eating,
    they went upstairs to their room.
    Robert, according to deputies, was
    preparing to remove a cartidge
    from a .22 caliber rifle when the
    weapon discharged. The shell
    struck Herbert in the face.
    A sister heard the shot and
    called police.
    Herbert had been living at the
    home of his uncle and grandmother,
    Keith Bane and Mrs. Clara
    Bane, since th e death of his
    parents in 1953. His parents, Mr.
    and Mrs. Howard Bane were killed
    in an Orleans County auto accident.
    The youth was a seventh-grader
    at Lyndonville Central School
    and a member of the Yates Baptist
    Church. He was born in Lockport
    on April 22, 1949.
    Surviving besides his uncle and
    grandmother are three brothers,
    Pfc. Howard Bane of the United
    States Marine Corps, Camp Le-
    jeune, N.C., Pfc. Arnold Bane of

    the United States Army in Germany,
    and Robert Bane; three
    sisters, Miss Clara Bane, Miss
    Loretta Bane and Miss Shirley
    Bane, all at home, and a halfbrother,
    Harold Tanner of Sodus.
    There are also several other aunts
    and uncles.
    Funeral services will be held at
    1 p.m. Sunday from the Smythe
    Funeral Home, Lyndonville. Burial
    will be in Lynhaven Cemetery.

    Eight Barker children were parentless
    today as a result of an automobile
    accident' in which their
    father and mother, Mr. and Mrs.
    Howard Bane, West Lake Shore
    road, were killed early yesterday In
    Route 18 approximately four miles
    northwest of Lyndonville.
    State police said that the accident
    occurred about 1 a.m. when their
    car struck a tree and house and then
    burst into flames after overturning.
    Seven other persons were Injured
    during the weekend in area
    automobile mishaps as local - and
    state police described the period
    as one of the worst in recent
    weeks for traffic accidents.
    State police at Gaines reported
    that Mr. Bane, 41, and his wife,
    Laura, 38, were returning to their
    home from a shopping expedition
    in Lyndonville when their car apparently
    skidded and went out of
    control.
    Believe Kerosene Exploded
    One of two five-gallon kerosene
    containers in the car is believed to
    become ignited and exploded.
    Although the bodies of the couple
    were charred almost beyond recognition,
    Coroner David E. Fraser,
    Lyndonville, expressed the opinion
    that Mr. Bane and his wife died
    before the car caught fire.
    , A certificate of death ,is being
    withheld pending the results of an
    autopsy ordered by state police.
    Surviving are the eight children,
    John, 19, of Lockport; Clare, 15;
    Howard, 13; Arnold, 12; Loretta,
    seven; Robert, five; Herbert, three,
    and Shirley Bane, two, all at home;
    Mr. Bane's mother, Mrs. Clara Bane,
    and his sister, Mrs. Myrtle Hill, both
    of Rochester, and his four brothers.
    Let Bane, Rochester, and Keith,
    Robert and Earl Bane, all of Lyndonville.
    Mrs. Bane also is survived by her
    parents, Alonzo Tanner, Lockport,

    LYNDONVILLE - Mrs. Clara
    C. Bane, 78, of Marshall
    Road, died early today at her
    home here after a long illness.
    She was the daughter of Wil
    liam and Minnie Arndt, and
    was born July 13, 1890, in Burt.
    She married the late Timothy
    Bane of Lyndonville in 1906, and
    has resided in this area for
    more than 60 years.
    Mrs. Bane was a member of
    the United Methodist Church
    and the Gleaners Class of that
    church. Until recently, she was
    quite active in church affairs.
    She is survived by a daughter,
    Mrs. Stanley (Myrtle) Hill
    of Rochester; four sons, Leo of
    Rochester, and Keith Sr., Irving
    and Earl, all of Lyndonville; a
    sister, Miss Anna Miller of Buffalo;
    a brother, William Miller
    of Lyndonville; 28 grandchildren;
    34 great - grandchildren,
    and several nieces and nephews.
    Her son Howard Bane died in
    1953.
    Friends may call from 7-9
    p.m. today and from 2-4 and 7-9
    p.m. tomorrow at the Smythe
    Funeral Home, 112 N. Main St.,
    Lyndonville.
    Funeral services will be conducted
    at 2 p.m. Sunday by the
    Rev. Howard Warriner of United
    Methodist Church.
