    (Mike)_ Winters, 72, of 438
    Prospect St., died Thursday
    (March 2, 1972) at Lockport
    Memorial Hospital after a
    short illness.
    A native of Lockport, he was
    born April 12, 1899, the son of
    Carl and Ida Bewley Winters,
    and was a toolmaker at the
    Harrison Radiator Division of
    General Motors Corp. for 23
    years, retiring in 1964. He was
    a member of the First United
    °Presbyterian Church and the
    Turtle Club of Lockport.
    He is survived by six sons
    and two daughters, Herbert,
    Nelson, Elton and Charles
    Winters and Mrs. Duane
    (Doris) Jones, all of Lockport;
    Norman of North Tonawanda,
    Layton Winters of Corpus
    Christi, Tex., and Mrs. Robert
    (Eleanor) Sanford of San Jose,
    Calif.; a sister, Mrs. Clarence
    (Rena) Brandt of St.
    Petersburg, Fla.; 24
    grandchildren, 15 great-
    grandchildren and several
    nieces and nephews.
    Friends may call from 7 to 9
    p.m. Friday and from 2 to 4 an d
    7 to 9 p.m. Saturday and
    sunday at the Prudden and
    Kandt Funeral Home, 242
    Genesee St., where services
    will be held at 10 a.m. Monday.
    The Rev. Ivan Orloff will
    officiate.
    Burial will be in Chestnut
    Ridge Cemetery.

    LOCKPORT-Mrs. Hattie M.
    Winters, 68, of 438 Prospect St.,
    died at 1:30 a.m. today (April
    4; 1968) at her home where she
    apparently suffered a heart attack.

    The emergency rescue squad
    responded to a call from her
    home and oxygen was administered
    for 25 minutes before she.
    was prounounced dead by her
    family physician.
    Mrs. Winters was a native of
    Royalton, born Jan. 15, 1900,
    the daughter of William and
    Minnie Wittcop Veomett. She
    was a member of the First
    Presbyterian Church.
    She is survived by her hus-
    band, Unas, six sons and two
    daughters, H e r b e r t Winters,
    Lockport, Norman of North
    Tonawanda, Nelson, Elton,
    Charles, Mrs. Dwayne Jones,
    all of Lockport, Mrs. Robert
    (Eleanor) Sanford of St. Jose,
    Calif., and Layton Winters of
    Corpus Christi, Tex.; one brother,
    Franklin Veomett of Gasport,
    24 grandchildren, and nine
    great grandchildren.
    Beginning today, friends may
    call from 2 to 4 and 7 to 9 p.m.
    at the Prudden and Kandt Funeral
    Home where services will
    be held at 1 p.m. Saturday with
    the Rev. Ivan Orloff officiating.

    L O C K P O R T . Dec. 14.-Holding
    that seven out of eight children
    should be allowed to carry out their
    desires regarding the erection of
    a monument and headstones for
    their parents. County Judge William
    A. Gold today handed down a decision
    in which he granted permission
    for the removal of the bodies
    of Mr. and Mrs. Charles Winters
    from the lot of a daughter-in-law,
    Mrs. Rofena Fredericks, In Royalton
    Mountain Ridge cemetery, to Cold
    Springs cemetery at Lockport.
    A son, Neal A. winters, 430 Pros-
    pect street, Lockport, petitioned the
    court several months ago for per-
    mission to have the bodies moved.
    In the application he was joined
    by a brother and five sisters, Judge
    Gold said.
    The application was opposed by
    another son, Carl O. Winters. 31
    Canton street, Tonawanda and Mrs.
    Rofena Fredericks. 218 Park avenue,
    Lockport. Mrs. Fredericks is
    the widow of Otto Fredericks, who
    was a son of Mrs. Ida Winters
    Mrs. Winters died in 1929 and was
    burled on a lot formerly owned by
    the late Otto Fredericks tn Mountain
    Ridge cemetery, town of Royalton.
    When Mr. Winters died in
    1933 he was buried on the same lot.
    "It is apparent that a dispute
    arose with reference to placing a
    monument upon said lot." wrote
    Judge Gold In his decision Petitioner
    and the other children Joining
    with him had apparently selected
    a monument of a size and nature
    to which said Rofena Fredericks
    objected. She not only objected
    to the size of the monument, but
    also desired to have placed thereon
    the name 'Fredericks while petitioner
    and the children joining with
    him desired the name 'Winters' to
    be placed thereon
    "As a result of these differences
    some of the children purchased a
    cemetery lot at the Cold Springs
    cemetery and made provisions for
    removing the body of their parents
    to said lot. They intend to place
    thereon a monument and markers
    of their own choosing.
    "Seven of the eight children fa-
    vor the granting of this petition.
    "A son, Carl C. Winters, and said
    Rofena Fredericks object to the re-
    moval. They claim that it was the
    desire of said Charles Winters and
    Ida Winters to be buried upon this
    lot said Rofena Fredericks claims
    that said Charles Winters, prior to
    his death, had selected the type of
    monument and headstones which he
    desired to be placed upon said lot,
    but had never purchased the same,
    and that she is willing to have
    placed upon said lot the type of
    monument and headstones selected
    by said Charles Winters."
    Judge gold cited that the pro-
    ceeding was brought under section
    89 of the Membership Corporation
    law and he pointed out that the
    Court of Appeals had laid down a
    rule which should govern the course
    in determining an issue of this na-
    ture.
    "I can safely assume that said
    Charles Winters and Ida winters
    had expressed a desire to be buried
    on said cemetery lot, inasmuch as
    they owned no lot, and said Charles
    Winters had his wife, Ida Winters,
    buried there upon her death" point-
    ed out the judge. "It would be na-
    tural to believe that he intended to
    be buried there himself.
    "However, I feel that seven of
    the eight children should be allow-
    ed to carry out their desires to erect
    upon said lot such monument and
    headstones as they believe suitable
    in memory of their father and
    mother, provided the type and size
    of the same meets with the approval
    of the directors of the Royalton
    Mountain Ridge cemetery associa-
    tion.
    "If said Rofena Fredericks refuses
    to allow the same to be done, I
    feel that the seven children should
    be allowed to have the bodies of
    their parents removed to Cold
    Springs cemetery, where such mon-
    ument and headstones can be placed
    and in which event I hereby con-
    sent to such removal."
    Neal Winters was represented in
    the action by Attorney Warner P.
    Thompson of Thompson and
    Thompson. Appearing for Carl
    Winters and Mrs. Fredericks was
    Attorney J. Carl Fogle of Fogle,
    Redenkapp and Andrews.

    Ida Fredericka Winters, wife of
    Charles C. Winters died this morning;
    at her home, 44 Vine street.
    She leaves to mourn her loss besides
    her husband, three sons and five
    daughters, Carl C , and Cornelius A,
    of Tonawanda, N. Y.; Linus W„ of
    this city; Mrs. Wm. O. Prlckard,
    Mrs. Ed, O'Connor, Mrs. Fred
    Boehnke of Tonawanda, N. Y., and
    Mrs. Geo. C. Bewley and' Mrs, Clarence
    E. Brandt of this city.
    Funeral will be held at the home
    Thursday at 2 P. M., and 2:30 P. M.,
    from Trinity Lutheran church on
    Saxton street.
