    The death of .Otto Fredericks occurred
    this morning, of a paralytic
    stroke, at his home at Reynales Basin.
    He leaves to mourn their loss, his
    wife and nine small children. The
    funeral will be held Friday afternoon
    at three o'clock from the family residence,
    Rev. C. Poeckler, of the Trinity
    Lutheran church of Medina, will of
    flciate. Interment will be at Mountain
    Ridge cemetery.

    Holding that seven out of eight
    children should be allowed to carry
    out their desire regarding the erec-
    tion of a monument and headstone
    for their parents, County Judge
    William A. Gold today handed down
    a decision in which he granted per-
    mission for the removal of the
    bodies of Mr. and Mrs. Charles
    Winters from the lot of a daughter-
    in-law, Mrs. Rofena Fredericks, In
    Royalton Mountain Ridge cemetery
    to Cold Springs cemetery.
    A son, Neal A. Winters, 480 Pros-
    pect street, Lockport, petitioned
    the court several months ago for
    permission to have the bodies
    moved. In the application he was
    Joined by a brother and five sisters,
    Judge Gold said.
    The application was opposed by
    another son, Carl O. Winters, 31
    Canton street, Tonawanda, and
    Mrs. Rofena Fredericks. 318 Park

    Is the widow of Otto Fredericks,
    who was a son of Mrs. Ida Winters
    Died Several Yean Age.
    Mrs. Winters died in 1929 and was
    burled on a lot formerly earned by
    tha lata Otto Fredericks in Moun-
    tain Ridge cemetery, town of Roy-
    alton. When Mr. Winters died In
    1933 he was buried on the same lot
    "It is apparent that a dispute
    arose with reference to placing a
    monument upon said lot," wrote
    Judge Gold In his decision. "Peti-
    tioner, and the other children Join-
    ing with him, had apparently se-
    lected a monument of a size and
    nature to which said Rofena Fred-
    erick, objected, she not only ob-
    jected to the size of the monument,
    but also desired to have placed
    thereon the name, "Fredericks",
    while petitioner, and the children
    Joining with him. desired the name
    "Winters' to be placed thereon.
    "As a result of these dlfferences.
    some of the children purchased a
    cemetery lot at the Cold Springs'
    cemetery and made provision for re-
    moving the bodies ef their parents
    to said lot. They Intend to place
    thereon, a monument and markers
    of their own choosing
    seven of the eight children favor
    the granting of this petition.
    One Son Opposed
    "A son, Carl C. Winters and said
    Rofena Fredericks object to the re-
    movel. They claim that it was the
    desire of said Charles Winters and
    Ida Winters to be buried upon this
    lot. Said Rofena Fredericks claims
    that said Charles Winters, prior to
    his death had selected he type of
    monument and headstones which
    he desired to be placed upon said
    lot. but had never purchased the
    same and that she is willing to have
    placed upon sald lot the type of
    monument And headstones selected
    by said Charles Winters."
    Judge Gold cited that the pro-
    ceedings were brought under section
    89 of the Membership Corporation
    Law and he pointed out that the
    Court of Appeals had laid down a
    rule which shouldl govern the course
    In determining an Issue of this nat-
    ure.
    "I can safely assume that said
    Charles Wintere and Ida Winters
    had expressed a desire to be buried
    on said cemetery lot, inasmuch as
    they owned no lot, and,said Charles,
    Winters had his wife, Ida Winters
    burled there upon her death,"
    pointed out the-judge. It would'
    natural to believe that he In-
    tended to be buried there himself."
    Decide. With Majority.
    'However, I feel that seven of the
    eight children should be allowed to
    carry out their desires to erect upon
    said lot such monument and head-.
    stones as they believe suitable in
    memory of their father and mother.
    provided the type and size of the
    same meets with the approval of
    the directors of the Royalton
    Mountain Cemetery associa-
    tion.
    "If said Rofena Fredericks refuses
    to allow the same to be done, I fee
    that the seven children should be
    allowed to have the bodies of their
    parents removed to Cold Springs
    cemetery where such monument an d
    headstones can be placed, and in
    which event , I hereby consent to
    such removal."
    Neal Winters was represented in
    the action by Attorney Warner F.
    Thompson of Thompson and
    Thompson. Appearing for Carl
    Winters and Mrs. Fredericks was
    Attorney J. Carl Fogle of Fogle
    Bedenkapp and Andrews.

    LOCKPORT - Donald O.
    Fredericks of 68 Regent Ave.,
    died Thursday (April 3, 1969)
    at Lockport* Memorial Hospital
    after a long illness. .
    A native of Gasport, he was
    the son of Otto and Rofina Urtel
    Fredericks. He was a process
    engineer for the Chevrolet
    Division of the General Motors
    Corp. at Buffalo for many
    years, retiring two years ago.
    He was a member of Niagara
    Lodge 375 F&AM, and e past
    president of the Young Men's
    Republican Club, and a member
    of the lockport Zoning Board
    of Appeals. From 1942 to 1946,
    he served as Niagara County
    supervisor for the 8th Ward.
    He is survived by his wife
    Anne Kendzie Fredericks, a
    son, Duane G. Fredericks, a
    daughter, Mrs. Thomas J.
    (Diarm) Hafner, all of
    Lockport; seven, sisters, Mrs.
    Verna Mesler, Gasport, Mrs.
    Leo Grassman, Mrs. Edna
    Ferguson, Mrs. Ada Costello,
    Mrs. Lyndon Eaton, Mrs.
    Frances Wyrosz and Mrs.
    Charles Fitzgerald, all of
    Lockport; four grandchildren
    and several nieces and
    nephews.
    ° He also was the brother of
    the late Loid Fredericks who
    had been a former alderman-at-large
    in the city.
    Friends may call from 4 to
    4 and 7 to 9 p.m. at the Prudden
    and Kandt Funeral Home where
    services will be held at 2 p.m.
    Saturday.
    The Rev. Herbert L. Siegner
    will officiate.

    Gerald C. Fitzgerald (Jerry-Fitz) passed through the gates of Heaven on Thursday, November 10, 2017. He was born in Lockport on January 30, 1938 and lived his entire life in Lockport, NY; Jerry is survived by his loving wife of 49 years Helena (Weston); dear father of two sons, Brett A. (fiancée Angie Hughes) of Lake Worth, Florida and Paul A. (Lauren) of Frederick, Maryland; brother of Sheila Tracy (Charles Thrall) of Lockport, NY and Cheryl Ippolito (Anthony) of East Amherst, NY. He was adored by his grandchildren: Siena, Allison, Emily, Cade and Caroline and his many nieces, nephews, and countless friends.
     
    Jerry "Fitz" was preceded in death by his parents, Lina and Charles Fitzgerald, his brother Lynn Fitzgerald, and his in laws, Margaret and Stanley Weston.
     
    Jerry "Fitz" graduated in 1956 from Lockport Senior High School and worked many years at Simon Steel Mill and General Motors (Harrison Radiator). Jerry served as a member of the Army National Guard.
     
    Jerry "Fitz" was a devoted father and No. 1 fan for his boys baseball, swimming and scouting activities. In his youth, Fitz was batboy for Lockport Bus Lines baseball team; he was a member of the Lockport Moose Club and Past President of the Ancient Order of Hibernians. He and his wife researched their ancestry in 2008 with a trip to Ireland and Scotland; he was an avid Notre Dame, Green Bay Packers and Boston Red Sox fan.
     
    Relatives and friends may call Wednesday November 15th, 3-7 PM at Prudden and Kandt Funeral Home. A Mass of Christian Burial will be celebrated on Thursday at 10 AM, at St. John's Catholic Church; Burial at St. Charles Cemetery. In lieu of flowers, the family requests that donations be made to the: American Heart Association/ American Stroke Association, P.O. Box 417005, Boston, MA 02241-7005.

    Lynn Fitzgerald entered into rest October 15, 2015. Born February 16, 1943 in Lockport, he was the son of Charles and Lina(Fredricks) Fitzgerald.

    Lynn graduated from DeSales High School in 1961, worked for the Niagara County Golf Course and Bewley Blacktop & Paving and enjoyed bowling, golf, playing cards and baseball. He was "a friend to all who know him" and will be deeply missed.

    Beloved father of Charles (Jodie) Fitzgerald of Wisconsin, Thomas Fitzgerald of Maine and Matthew Holmes of Cherished grandfather of Carter and Isabella. Dear Brother of Sheila (Charlie Thrall) Tracy, Cheryl(Anthony) Ippolito and Gerald "Jerry" (Helen) Fitzgerald. Also survived by many nieces and nephews. Best friend of Charlie Thrall.

    The family will greet relatives and friends from 2-5 p.m. on Thursday at the TAYLOR & REYNOLDS FUNERAL HOME, 70 Niagara Street, concluding with a Celebration of Life. Shared memories from 4-5 p.m. Inurnment will be in Glenwood Cemetery at the convenience of the family.
