In the absence of a written agreement or other competent
evidence. Surrogate John S. Marsh has denied a claim of Mrs,
    S. Evelyn Brick. Town of Cambria, who sought a share in
$15,000 realized from die sale of a farm and personal property
left by her late son. Glenn A. Brick. Town of Cambria.
The property had basn sold by
the widow, Ruth H. Brick, as ad
minlstratrix of the estate, and the
proceeds had bean ordered bald until
the cllam of Mr. Brick's mother
    was heard.
Mr Brick died Oct. 29,1948, leaving
    his widow and two children.
Eric Glen Brick, 2, and Jerry Carl
Brick. 1. A t the time of hie death
the family occupied a farm In the
    town of Cambria,
    FORMERLY OWNED FARM
Mr. Brick'a mother also lived on
the farm which originally had been
Owned by her and her late husband
In 1944 and 1945 she conveyed
the farm, stock and tools to her
    son.
It was the contention of Mr.
Brick's mother that In addition to
    other considerations, bar eon
agreed to permit her to lire In one
of the houses on the farm for the
rest of her life without charge, She
said he also agreed to pay her one
half of the milk checks, allow bar
subsistence off the. farm and pay
the expenses of his sister. Sue,
    through school.
Judge Marsh cited that the court
    being called upon by Mrs.
Brick "to give effect to an alleged
oral agreement which it is claimed
    survives the promisor and imposes
    upon his estate substantial obligations."
    SON'S OBLIGATION CITED
    "That the son evidenced a
of obligation to bis mother in
nection with bis occupancy of the
farm during his lifetime falls far
short of an acknowledgment of a
    continuing charge which would be
required to be imposed on those to
whom he owed an equally strong
    obligation and daty following h i s
    death," Judge Marsh said.
    The widow was represented to
the action by Pogle, Andrews and
