Lockport. May 8.-Albert Berner, the
Stayton Settlement farmer who charges
Fred Skinner of this city with eloping
with his wife and the pair with stealing
$280 of his money, has begun an action
against Skinner for $10,000 damages for
alienation of his wife's affections. He
also had begun an action against his wife
for an absolute divorce.
Skinner and Mrs. Berner were brought
ore Police Justice Stevens on the
rand larceny charge. Mrs. Berner is a
comely brunette of large build and comliag
appearance. Skinner is a rathhmlgnincant
appearing man. The Berters
have five children. Two little girls,
hue seven and another eleven were in
court The latter testified that her moth-
er went away with Skinner on the morn-
ing of April 18th and the witness had not
seen her until she reached the court
room.
Judge Stevens decided that there was
not sufficient evidence to hold the parties
on the charge of grand larceny and
they were discharged. Berner has also
begun another against his wife
to recover the $280. The farm on which
the Berners live is in Mrs. Berner's
name and she claims she had a right
to the money.
